To file or not to file for a MA Paid Family Leave Exemption

Many employers have taken a wait and see approach about seeking DFML approval to operate a private paid family and/or medical leave plan for their employees to commence January 1, 2021. That wait seems to be over and there is still time to act. DFML approval means the employer is exempt from collecting, remitting and paying contributions to the PFML trust fund each quarter the exemption is in effect. DFML approval by December 20, 2019 will be effective retroactive to October 1, 2019.

Given the PFML is so new there is no sure-fire way to accurately predict whether an exempt private employer plan as an alternative to the PFML is right for an employer.
